Tuan Sekretaris yang Mulia,

Kami sangat kecewa dan gusar setelah mengetahui akan dimulainya kembali Dialog Pertahanan Bilateral antara Armada Amerika Serikat di Pasific dan Tentara Nasional Indonesia (TNI). Langkah untuk normalisasi hubungan militer-militer ini tanpa membuat syarat kepada TNI agar melakukan reformasi, adalah suatu hal yang sangat memprihatinkan.

Seperti Tuan ketahui, Dialog Pertahanan Bilateral antara Indonesia dan Amerika Serikat telah dihentikan sejak 1997, karena antara lain keganasan luarbiasa yang dilakukan TNI di Timor Timur, terutama sekali dalam tahun 1999. Sejak saat itu, TNI juga berhasil menghindari tanggung jawab atas kejahatan kemanusiaan dan kejahatan perang yang mereka lakukan, padahal kejahatan-kejahatan itu telah didokumentasikan dengan baik. Ditambah lagi dengan taktik brutal yang terus menerus dilakukan oleh TNI di Acheh, Papua dan di daerah-daerah lain. Dilaporkan juga adanya hubungan yang sangat dekat antara TNI dengan kelompok terror Laskar Jihad, yang kembali muncul ketika kekerasan di Maluku meletus. Laskar Jihad juga diketahui beroperasi di Papua. TNI juga terlibat dalam pembunuhan dua warganegara Amerika Serikat, Rick Spier and Ted Burgon, yang telah disimpulkan oleh Kedutaan Amerika Serikat di Jakarta sebagai, "tindakan terrorisme yang sangat keji". Dan kami sangat senang dengan adanya tuntutan resmi atas kasus ini, dan kami percaya bahwa investigasi yang lebih jauh diperlukan untuk mencari siapa yang bertanggung jawab dibalik penembakan itu.

Dengan adanya bukti nyata bahwa berbagai pelanggaran berat Hak Asasi Manusia yang dilakukan oleh militer Indonesia tidak terselesaikan dengan tuntas, kami, dengan penuh hormat meminta kepada Tuan Sekretaris untuk mempertimbangkan kembali pembukaan Dialog Pertahanan Bilateral itu dengan Indonesia. Kami yakin, memulai kembali dialog pada saat sekarang adalah berlawanan dengan sikap Congress yang tegas sekali serta Keputusan Pemerintah A.S. sendiri pada akhir tahun 1990, dalam hal pengurangan drastis bantuan, latihan, dan pertukaran personnel militer dengan TNI sehingga permasalahan Hak Asasi Manusia benar-benar diperhatikan.

Memang TNI telah melakukan beberapa perubahan seperti menahan diri dari mencampuri urusan pemilihan umum pada 5 April yang lalu, namun TNI tidak perlu diberikan penghargaan yang berlebihan atas perubahaan yang sangat kecil itu. Tidak adanya kebusukan yang dilakukan TNI pada saat pemilihan umum adalah suatu hal yang wajar dan tidak perlu terlalu dipuji. Memang disambut baik penarikan TNI dari parlemen beberapa tahun lalu, namun kekuatan nyata militer masih terletak pada stuktur komando territorial yang masih utuh sampai saat ini.

Di masa datang, memang ada kemungkinan normalisasi hubungan antara militer US dan Indonesia, namun sebelum itu mesti ada reformasi yang hakiki dalam tubuh TNI, sesuai dengan standar yang tersusun baik termasuk penghormatan terhadap Hak Asasi Manusia, memegang ketentuan hukum, dan kemestian mengakhiri kekebalan hukumnya atas pelanggaran-pelanggaran berat Hak Asasi Manusia yang telah dan sedang dilakukannya. Semua ini adalah ketentuan yang mesti dimiliki oleh semua militer professional di dunia ini, tidak terkecuali TNI.

Kami meminta kepada Departemen Pertahanan untuk menyatakan keprihatinannya kepada seluruh lapisan pimpinan TNI, tentang pelanggaran-pelanggaran brutal Hak Asasi Manusia yang dilakukan TNI. Harapan kami agar supaya Tuan Sekretaris memberi tekanan atas beberapa hal yang sangat penting, seperti operasi militer yang dilaksanakan TNI di Acheh dan Papua, keterlibatan TNI dalam kerusuhan di Maluku, pembunuhan dua warganegara Amerika, keadilan untuk Timor Timur dan transparansi dana militer.

Adalah suatu kemestian yang mutlak, bahwa keprihatinan-keprihatinan ini jangan sampai diabaikan demi menggapai tujuan yang lain. Kami sekali lagi mendesak Anda, Tuan Sekretaris untuk mempertimbangkan kembali keputusan memulihkan Dialog Bilateral Pertahanan antara militer Indonesia dan Amerika Serikat.

Reps Write Rumsfeld on US-Indonesia Military to Military Ties

Dear Secretary Rumsfeld,

We were surprised and disappointed to learn that the Bilateral Defense Dialogue between the U.S. Pacific Command and the Indonesian military (TNI), is scheduled to reconvene. This additional step towards resumption of normalized military to military relations without setting benchmarks for a reform of the TNI is a cause for concern.

As you may know, a Bilateral Defense Dialogue (BDD) between Indonesia and the U.S. has not occurred since 1997, in part because of the tremendous TNI violence committed in East Timor in 1999. Since then, the TNI has successfully evaded accountability for its well-documented crimes against humanity and war crimes in East Timor, and there has been little progress in improving human rights practices in Indonesia. Additionally, the TNI continues its brutal tactics in Aceh, Papua, and elsewhere. There are reports that the TNI has extensive connections to the terror group Laskar Jihad, which has re-emerged in renewed violence in Maluku and is operating in Papua. The TNI is also implicated in the murder of U.S. citizens Rick Spier and Ted Burgon, in what the U.S. Embassy in Jakarta described as "an outrageous act of terrorism." Although we are pleased that an indictment was recently issued in this case, we believe that further investigation into collaborators in this ambush is warranted.

Given the fact that so many serious human rights issues relating to the Indonesian military remain unresolved, we respectfully ask you to reconsider resuming the Bilateral Defense Dialogue. We believe a resumption of the dialogue at this time would go against the strong posture Congress and the Executive Branch took in the late 1990's to severely limit military assistance, joint exercises, and exchanges with the TNI until human rights issues were addressed.

While the TNI is being given credit for some reforms, including refraining from interfering in the April 5th national election, they should not be given too much credit for too little reform. The absence of misconduct by the military in an election should be expected, not praised. The TNI's welcome withdrawal from parliament occurred several years ago; the military's real power lies in its vast territorial command structure, which remains intact.

In the future, there may be a possibility of normalized US- Indonesia military to military ties, but first we must have genuine reform of the TNI according to well-laid out benchmarks that include a respect for human rights and the rule of law and an end to impunity for serious human rights violations. These are objectives expected of any professional military and the TNI should not be an exception.

We request that the Department of Defense voice its concern with all levels of leadership in the TNI about the brutal human rights record of the Indonesian military. Specifically, we hope that you can weigh in on critical issues such as the military campaigns in Aceh and Papua, the role of Indonesian security forces in the violence in Maluku, the murder of Americans, justice for East Timor, and transparency in the TNI budget. It is imperative that these concerns not be waived in the pursuit of other goals. We again urge you to reconsider the decision to resume the United States' Bilateral Defense Dialogue with the Indonesian military.
